The LGA has secured agreement that elected members will be exempt from having to pay a data protection charge under DPA. Councillors will of course still be required to abide by the regulations.
The Government response to the consultation on exemptions to the ICO data protection charge has now been published. It sets out Government’s intention to introduce a new exemption from payment of the data protection charge for all processing relating solely to standing for or fulfilling the office of all categories of elected representatives as defined in paragraph 23(3) of Schedule 1 to the Data Protection Act 2018 and members of the House of Lords.
